ARTICLE 1 – PURPOSE – SCOPE

1.1 These General Terms and Conditions of Sale (hereinafter referred to as the “GTCS”) are intended to govern all sales concluded by the company BLACKMAMBA (hereinafter referred to as the “Seller”) under the BlackMamba brand, with a consumer or professional buyer (hereinafter referred to as the “Buyer”).

Sales are notably carried out via the website: www.blackmamba-europe.com.

Professional Buyers may not rely on provisions of the French Consumer Code applicable solely to consumer Buyers.

The GTCS are systematically provided to the Buyer upon the creation of their customer account, and the Buyer undertakes to return them signed to the Seller.

The GTCS are subsequently recalled in order confirmation emails (acknowledgment of receipt).

1.2 These GTCS prevail over any other clause or provision appearing in orders, correspondence, brochures, catalogs, photographs, or any other exchanged documents.

The fact that the Seller does not enforce any provision of the GTCS at a given time shall not be interpreted as a waiver of the right to enforce it later.

1.1   The sales offer proposed by the Seller on the Website:

-          is exclusively intended for customers having the legal capacity to contract;

-          concerns only sales delivered within mainland France.

1.4 The Seller reserves the right to amend these GTCS at any time. In the event of modification, the applicable GTCS shall be those in force on the date of the order, a copy of which is sent to the Buyer in the order confirmation email.

1.5 If any clause of the GTCS is declared null or void, the remaining clauses shall remain valid.

ARTICLE 2 – ORDERS

Product characteristics are available on the website www.blackmamba-europe.com.

Orders may be placed by phone, email, or via the website. They must include all necessary information, particularly the product reference or, failing that, a detailed technical description.

Once the order is recorded, the Seller sends an acknowledgment of receipt by email summarizing:

-          product references,

-          unit prices,

-          total amount,

-          accepted payment methods,

-          applicable delivery fees.

The order becomes final only after full payment has been received.

ARTICLE 3 – PRICES

3.1 Prices are indicated on the website in euros (€), all taxes included (VAT included), excluding shipping costs.

Applicable taxes, including VAT, are those in force on the day the order is placed.

Shipping costs:

Home delivery:

-          < 5 kg: €14 incl. VAT

-          5–10 kg: €18 incl. VAT

-          10–15 kg: €22 incl. VAT

-          15 kg: €26 incl. VAT

Relay point delivery:

-          < 5 kg: €8 incl. VAT

-          5–10 kg: €15 incl. VAT

-          10–15 kg: €22 incl. VAT

ARTICLE 4 – PAYMENT

Payment is made in euros (€) by cheque, bank transfer, or any other method available on the website.

The invoice will be provided upon delivery or sent electronically.

ARTICLE 5 – DELIVERY

5.1 Delivery takes place only after full payment is received. In the case of payment by cheque, delivery occurs after the cheque has cleared.

Products are delivered to the address indicated by the Buyer according to the chosen delivery method.

5.2 Deliveries are limited to mainland France.

The Buyer may specify a delivery address different from the billing address.

5.3 Deliveries are made on working days, excluding public holidays, via the carrier chosen by the Seller.

5.4 For consumer Buyers, delivery is made within a maximum of 30 days following order confirmation, in accordance with Article L.216-1 of the French Consumer Code.

In case of delay, the Buyer may cancel the contract under the conditions set out by law.

The Seller will refund all sums within 14 days following contract termination.

Delays due to the Buyer, force majeure, or unforeseen events do not engage the Seller’s liability.

5.5   The Buyer must provide an accurate delivery address and ensure accessibility.

In case of incorrect address:

-          reshipping costs are borne by the Buyer;

-          the Seller may claim compensation for damages caused.

ARTICLE 6 – RECEIPT

6.1   Upon delivery, the Buyer must verify:

-          condition,

-          quantity,

-          conformity of products.

6.2   In case of damage:

-          reservations must be made on delivery documents;

-          the carrier must be notified within 3 days (or 10 days for consumers if inspection was not possible).

The Seller must also be informed immediately.

ARTICLE 7 – FORCE MAJEURE

The Seller shall not be liable for failure due to force majeure.

Obligations are suspended during such events.

After 1 month, the Seller may cancel the order and refund the Buyer.

Force majeure includes (non-exhaustive list): war, riots, strikes, pandemics, epidemics.

ARTICLE 8 – RIGHT OF WITHDRAWAL

8.1 Consumers have 14 days to withdraw without justification.

The period begins upon receipt of goods.

Withdrawal can be exercised via: mail, email, online form.

Proof of withdrawal lies with the Buyer.

8.2 Effects
The Buyer must return products within 14 days.

Return costs are borne by the Buyer.

Products must be:

-          unused,

-          complete,

-          in original packaging.

Refund includes product price + delivery + handling fees.

No refund if products are damaged, incomplete, or opened (for hygiene reasons).

Refund within 14 days after receipt of returned goods.

ARTICLE 9 – WARRANTIES

9.1 Legal conformity warranty (Consumer Code) and hidden defects warranty (Civil Code) apply.

Non-conforming products must be reported to customer service.

Products must be returned: unused, complete, in original packaging.

The Seller inspects within 1 month.

9.2   Consumer rights:

-          2-year period to act,

-          choice between repair or replacement,

-          no proof required within 24 months (12 for second-hand goods).

9.3   Hidden defects warranty:

-          defect must be hidden and pre-existing,

-          Buyer has 2 years from discovery,

-          may request cancellation or price reduction.

ARTICLE 11 – LIABILITY

The Seller is not liable in cases of: third-party fault,buyer fault, force majeure.

For professional Buyers:

-          no liability for indirect damages,

-          liability limited to order amount.

Claims must be made within 6 months.

 

ARTICLE 12 – APPLICABLE LAW – DISPUTES

12.1 Personal data
The Seller complies with GDPR (EU Regulation 2016/679).

Data is used for order processing and may be shared with partners.

Buyers may exercise rights of access, correction, or deletion.

12.2 French law applies.
